Liability Assessment
Even if you were partly to blame, a firm of personal injury solicitors can still claim motor accident compensation on your behalf. If you were a passenger and the driver of your car was at fault you can still claim compensation. Even if the driver was your cohabitee, spouse or a family member you are entitled to claim compensation from their insurance company. Road traffic accident compensation claims will succeed even if the other driver was uninsured or if it was a hit and run accident by making application for compensation to the Motor Insurers Bureau.
Preservation of Evidence
The success of road traffic accident compensation claims depends on evidence which should be preserved as follows :-
- Record the full name, address, vehicle registration and insurance details of the other driver.
- If the police attend note their collar numbers and obtain the crime report reference number.
- Record the name, address and telephone numbers of any witness.
- Leave the matter of written statements in road traffic accident compensation claims to your solicitor.
- Draw a sketch of the sequence of events including vehicle positions before and after the accident.
- Take photographs of the accident location, property and vehicle damage and any visible injury.
- Report the accident to your own insurers even if you believe it was the other persons fault.
- Keep a daily diary following the accident to record the progress of your injuries and any free help that is given to you
- Keep receipts for all expenses
- Make as little comment on the circumstances of the accident as possible to the other driver and do not admit liability even if you think it was your fault - any admissions or statements may cause difficulty for the solicitor instructed to act on your behalf in subsequent road traffic accident compensation claims.

EURO NCAP SAFETY TESTS
Euro NCAP was established in 1997 and provides independent and accurate information about the safety performance of models of cars through rigorous testing procedures. All new car models must pass safety tests established on a national legal basis before they are sold however many manufacturers also carry out additional testing which is not required by law. Euro NCAP uses test procedures based on European Union safety standards for front and side impact and tests are also undertaken to assess the risk to pedestrians if struck by the front of the car. It is believed that the public will show sufficient interest in the extra safety features offered on certain models as a result of these tests that they will influence buying trends and therefore ensure that more manufacturers include additional safety features in their volume produced cars over and above the safety measures strictly required by law thereby enhancing overall safety for both drivers and pedestrians. It is hoped that greater public awareness of the dangers of road accidents, together with the design and engineering skills of the car industry will significantly reduce the number of injuries that are serious enough to justify legal action for road traffic accident compensation claims.
- The NCAP tests provide an independent source of information on the crash safety of new cars.
- Included are front-impact, side-impact and head-protection tests, as well as a pedestrian test which determines the level of injury to a pedestrian hit by the vehicle.
- In the front-impact test, the car is driven head-on into a deformable barrier at 40 mph.
- In the side-impact test, a trolley with a deformable front is crashed into the driver's side of the car at 30 mph.
- In the head-protection test, a pole is accelerated sideways through the driver's side of the car at head level, at 18 mph.
- In the pedestrian tests, wired-up dummies provide information about the levels of force that hit them and the areas of 'injury', enabling researchers to predict the outcome of the accident had real people been involved.
- The newer the car, the safer it is. The risk of serious injury or death has declined by more than 20 per cent in the past 10 years, thanks to airbags, stronger "safety cages", seatbelt pre-tensioners etc.
- Larger, heavier vehicles are safer than smaller, lighter ones.
- Tall vehicles with a high centre of gravity, such as 4x4s and pick-ups, are more likely to roll over in the event of an impact.
