Financing Accident Claims

  • No Win No Fee.
    Before 1998 Legal Aid was available to take proceedings for all personal injury claims however upon the introduction of the no win no fee scheme Legal Aid was withdrawn for most personal injury claims. Legal aid is still available for medical negligence claims. A solicitor acting under a no win no fee agreement is only entitled to be paid his charges if he wins the case and that payment is made by the losing side. If the case is lost then the solicitor will be unable to claim his fees from either the third party or his client and must effectively write them off.
  • Private Funding.
    Personal injury claims are rarely paid for privately as most people use the no win no fee scheme which effectively gives free legal help and removes any financial risk. If an accident compensation claim is funded privately and it is won and valued at more than £1,000 then the other side must pay compensation and legal costs, conversely if the claim is lost then the other side's legal costs must be paid. Insurance to cover the risk of losing the claim and being ordered to pay the other sides costs is advisable however in a privately funded case that insurance will only cover the other sides costs leaving the claimant to pay his own solicitors costs.
  • Legal Expenses Insurance
    Some household and other insurance policies have legal expenses cover to pay for a solicitor to take legal action and this cover often extends to personal injury compensation claims. If there is valid legal expenses insurance available then there will be no need to enter into a no win no fee agreement with a solicitor as the insurers will fund any legal action and will indemnify the policy holder against loss and against the potential for a costs order made in favour of the third party in the event that the cases is lost.
  • Unions and Professional Associations
    Members often have the benefit of free legal help to take or defend actions. Claimants should check with their representatives to see if funding is available for free referral to a solicitor. Most Unions have now almost abandoned this type of funding and inevitably recommend their members to find a solicitor who will take the risk of no win no fee legal action.
